ArtsyGeeksy brings several creative projects together under one umbrella. Depending on where you wander, you may find:

2. General Educational and Creative Content

Most of the articles, recordings, tools, recipes, essays, gaming materials, and other resources on our Services are provided for educational, informational, creative, or entertainment purposes.

We work hard to create useful, thoughtful, and accurate material. We are still human, however, and humans are famously capable of typos, miscalculations, changed circumstances, missing ingredients, broken links, and occasionally discovering that a seemingly reliable source was talking through its hat.

We do not promise that every piece of content will always be complete, current, accurate, suitable for your circumstances, or free from errors. You are responsible for deciding whether and how to use the information provided.

Nothing on the Services should be treated as medical, nutritional, legal, financial, scientific, navigational, emergency, or other professional advice.

3. Music, Recordings, and Streaming Links

Justin Towson Music may include original recordings, performances, playlists, biographies, program notes, educational articles, artwork, and links to music hosted by third-party streaming platforms.

Music hosted by Spotify, SoundCloud, YouTube, or another service is also governed by that platform’s terms and policies. We do not control whether a third-party platform changes its features, removes a recording, alters its subscription requirements, restricts access in a particular location, or stops working altogether.

Unless we clearly state otherwise, recordings, original arrangements, written commentary, photographs, artwork, playlist descriptions, and other original materials remain protected by copyright. The fact that an underlying musical composition may be in the public domain does not make our recording, arrangement, artwork, or written material public domain.

You may listen to and share links to publicly available music in the ordinary ways permitted by the applicable platform. You may not copy, reproduce, download, redistribute, sell, sample, synchronize, alter, or commercially exploit our recordings or other protected materials without permission, except where the platform or applicable law expressly permits it.

4. Recipes and Food Content

Recipes, cooking instructions, ingredient information, and other food content provided through EatsyGeeksy are intended for general informational and recreational use.

Ingredients, appliances, cooking times, brands, elevations, temperatures, and individual skill levels vary. We cannot guarantee that your results will look, taste, rise, brown, thicken, crisp, melt, or otherwise behave exactly like ours.

You are responsible for:

• Checking ingredients for allergens and dietary restrictions
• Preventing cross-contamination
• Using knives, appliances, heat, pressure cookers, grills, and other equipment safely
• Storing, preparing, and cooking food at appropriate temperatures
• Determining whether a recipe is suitable for your health, diet, or household

Ingredient substitutions and product recommendations may not be appropriate for everyone. Anyone with food allergies, medical dietary restrictions, swallowing concerns, or other health needs should consult an appropriate professional rather than relying solely on our content.

References to a product, appliance, ingredient, restaurant, or brand do not guarantee its safety, availability, quality, or suitability.

5. Æthenæum, Ephemeris, Time, Date, and Space Information

Æthenæum may provide educational articles and interactive information involving astronomy, celestial events, calendars, dates, times, locations, moon phases, moonrise and moonset, sunrise and sunset, planets, stars, mythology, folklore, astrology, and related subjects.

Ephemeris and celestial information may be calculated using location information, dates, times, time zones, software, mathematical models, algorithms, external datasets, or information supplied by you or your device.

Although we make reasonable efforts to provide useful results, displayed information may be approximate or affected by:

• Incorrect, incomplete, or outdated location information
• Device-location or browser errors
• Time-zone and daylight-saving-time settings
• Atmospheric conditions and refraction
• Local terrain, buildings, elevation, or horizon obstructions
• Differences among astronomical models or datasets
• Software, display, transmission, or calculation errors

Do not rely on Æthenæum or its tools for aviation, maritime navigation, wilderness navigation, emergency response, legal deadlines, medical decisions, safety-critical activity, professional scientific work, or any situation in which an inaccurate time, location, or astronomical calculation could cause harm or significant loss. Confirm important information through an appropriate authoritative source.

Content concerning mythology, symbolism, folklore, divination, or astrology is provided for cultural, historical, educational, or entertainment purposes. It should not be treated as a guaranteed prediction or as medical, financial, legal, or professional advice.

When you choose to provide or allow access to location information, its collection and use are governed by our Privacy Policy.

6. Gaming Content

Roll Model Gaming may include original settings, adventures, creatures, game aids, reviews, commentary, maps, downloadable resources, and other tabletop gaming material.

Game systems, groups, players, and campaigns differ. We do not guarantee that any particular encounter, rule interpretation, creature, adventure, or resource will be perfectly balanced, compatible with every edition or system, or appropriate for every table.

Game Masters and players are responsible for reviewing materials, adapting them to their group, establishing boundaries, and deciding what content is suitable for their players.

References to third-party games, publishers, systems, characters, trademarks, or other properties belong to their respective owners. Unless we expressly say otherwise, such references do not mean that ArtsyGeeksy or Roll Model Gaming is sponsored, endorsed, licensed, or affiliated with those owners.

7. Accounts and Account Security

Some portions of the Services may allow you to create an account.

You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity conducted through your account unless it resulted from a security failure for which we are legally responsible.

Please contact us promptly if you believe your account or purchasing information has been accessed without permission.

We may suspend or close accounts that violate these Terms, threaten the security of the Services, engage in fraud, or interfere with other users.

8. Comments and Other User Contributions

Some pages may allow comments, reviews, messages, submissions, or other user-provided content.

You retain ownership of content you submit. By submitting it through the Services, you give us a nonexclusive, worldwide, royalty-free license to store, reproduce, format, and display that content as reasonably necessary to operate, maintain, moderate, and present the applicable Service.

Ordinary search-engine indexing and accessibility technology are not prohibited by this section.

10. Our Intellectual Property

Unless otherwise identified, the original content available through the Services belongs to Just-n-Sun Enterprises, LLC, its creators, or its licensors.

This includes, among other things:

• The ArtsyGeeksy name and original branding
• Artwork, illustrations, designs, and photographs
• Articles, essays, recipes, descriptions, and other writing
• Recordings, performances, and original arrangements
• Gaming settings, creatures, adventures, maps, and game materials
• Digital downloads and printable materials
• Website layouts, graphics, and original software
• Compilations, collections, and original selections or arrangements of content

These Terms allow you to use the Services. They do not transfer ownership of our intellectual property to you.

You may share ordinary links to public pages and quote brief portions for commentary, criticism, education, or other uses allowed by law, with appropriate attribution. Any broader reproduction, publication, adaptation, commercial use, or distribution requires permission unless a specific product license says otherwise.

11. Third-Party Links and Services

The Services contain many links to places outside the ArtsyGeeksy umbrella. That is part of their purpose. These may include streaming services, social platforms, retailers, reference sources, payment processors, email providers, printers, fulfillment companies, mapping or location services, and other websites.

A link does not necessarily mean that we control, endorse, or guarantee the linked service or everything published there.

Third-party services have their own terms, privacy practices, accessibility, content standards, prices, and technical requirements. We are not responsible for their content, availability, security, policies, or actions.

When you leave our Services or complete a transaction through a third-party provider, your use of that provider is governed by its terms as well as any applicable portions of these Terms.

12. Product Information and Pricing

We try to describe and display products accurately. Colors, proportions, textures, print placement, packaging, and other details may vary slightly because of screens, photography, materials, manufacturing, or print-on-demand production.

Prices, availability, descriptions, and promotions may change without notice before an order is accepted.

Despite our best efforts, a listing may occasionally contain an incorrect price, description, image, discount, or availability status. If we discover a material error before fulfillment, we may contact you for instructions or cancel the affected order and refund the amount charged.

13. Orders and Payment

By placing an order, you represent that:

• The information you provide is accurate
• You are authorized to use the selected payment method
• You are legally able to enter into the purchase
• You will pay the displayed price, taxes, shipping, and other charges disclosed before checkout

An automated order-confirmation message acknowledges that we received your order. It does not necessarily mean that the order has been accepted or fulfilled.

We may decline or cancel an order because of suspected fraud, payment problems, inventory errors, pricing mistakes, legal restrictions, technical problems, or inability to fulfill the order. If we cancel an order after payment has been collected, we will refund the applicable amount.

Payments may be processed by a third-party payment provider. We generally do not receive or store your complete payment-card number.

14. Physical Merchandise

Physical products may be created, printed, packaged, or shipped by us or by third-party production and fulfillment partners.

Estimated production and delivery dates are estimates unless expressly identified as guaranteed. Shipping times may be affected by carriers, weather, holidays, customs, supply issues, incorrect addresses, or other circumstances outside our reasonable control.

We will ship orders within the time stated at checkout or otherwise communicated to you. If we cannot do so, we will provide the notices, cancellation options, or refunds required by applicable law.

You are responsible for providing a complete and accurate delivery address. Additional charges caused by an incorrect or incomplete address may be your responsibility to the extent permitted by law.

Risk of loss and ownership of physical products transfer as provided by applicable law and the shipping terms disclosed during checkout.

15. Digital Products and Downloads

Digital products may include artwork, books, printables, templates, gaming resources, maps, music-related materials, guides, or other downloadable files.

Unless a product listing clearly provides a different license, purchasing or downloading a digital product gives you a limited, nonexclusive, nontransferable license to use it for your own personal, noncommercial purposes.

You may make reasonable backup copies and print copies for your own use. Where appropriate, you may also use gaming materials during a private game with your regular gaming group.

You may not:

• Resell, sublicense, share, upload, or redistribute the original files
• Post the files publicly or place them in a shared download repository
• Claim the work as your own
• Remove copyright or creator information
• Turn the files into another product for sale
• Use the files in merchandise, advertising, publishing, or other commercial work
• Use the files or their contents to train a generative-AI or machine-learning system
• Provide access to the files as part of a paid membership, course, library, bundle, or subscription

A purchase does not transfer copyright or ownership of the underlying work.

Digital files may be delivered by email, customer account, browser download, or a link provided by a third-party platform. You are responsible for supplying a working email address, downloading the file within any stated access period, and maintaining your own backup after delivery.

You are also responsible for confirming that you have compatible software, equipment, storage, and printing capabilities before purchasing.

If a file is missing, corrupted, materially different from its description, or inaccessible because of a problem on our side, please contact us so we can provide a replacement, troubleshooting assistance, or another legally appropriate remedy.

16. Returns, Exchanges, and Refunds

Our current Shipping, Returns, and Refund Policy is incorporated into these Terms. Please read it before placing an order.

Return eligibility may differ between physical merchandise and digital products.

Because a digital product cannot ordinarily be returned after it has been accessed or delivered, digital purchases are generally final unless:

• The file is defective, corrupted, or inaccessible
• You were charged more than once for the same purchase
• The product was materially misdescribed
• We are unable to provide the purchased file
• A refund is otherwise required by law

This does not limit any consumer right that cannot legally be waived.

For physical merchandise, the applicable return window, item-condition requirements, exclusions, return-shipping responsibility, and procedures will be stated in our posted Returns and Refunds Policy.

17. Taxes and Other Charges

You are responsible for taxes, duties, customs charges, or similar amounts associated with your purchase when applicable.

The amount shown at checkout may include taxes calculated by our ecommerce or payment provider. International customers may be responsible for additional charges imposed by their country or delivery service.

18. Newsletters and Communications

When you subscribe to a newsletter or marketing list, you agree to receive the communications described at signup.

You may unsubscribe from promotional emails using the link included in the message. Unsubscribing from marketing messages does not prevent us from sending transactional or administrative messages concerning an order, account, security issue, or requested service.

Delivery of email is not guaranteed. Messages may be delayed, filtered, or blocked by your provider.

19. Children

The Services are intended for a general audience and are not directed to children under 13.

To the fullest extent permitted by law, the Services and their content are provided on an “as is” and “as available” basis.

We do not guarantee that the Services will be uninterrupted, completely secure, error-free, or suitable for every purpose. We do not guarantee particular results from a recipe, download, product, game resource, article, recording, ephemeris calculation, or other content.

Nothing in these Terms excludes a warranty or consumer protection that cannot lawfully be excluded.

23. Limitation of Liability

To the fullest extent permitted by law, Just-n-Sun Enterprises, LLC and its owners, contributors, contractors, partners, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Services.

This includes loss resulting from reliance on content, third-party links, unavailable downloads, deleted user content, service interruptions, incompatible files, shipping delays, cooking outcomes, gaming outcomes, or inaccurate time, location, or astronomical information.

To the fullest extent permitted by law, our total liability arising from a particular purchase will not exceed the amount you paid for that purchase. For claims unrelated to a purchase, our total liability will not exceed $100.

These limitations do not apply to liability that cannot legally be limited, including liability arising from fraud, intentional misconduct, or other matters for which exclusion is prohibited by law.

24. Your Responsibility for Misuse

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from:

• Content you submit
• Your unlawful misuse of the Services
• Your violation of these Terms
• Your infringement of another person’s rights

This section does not require you to be responsible for conduct caused solely by us.

25. Suspension or Termination

Provisions that logically need to continue after termination, including intellectual-property, payment, disclaimer, and liability provisions, will remain in effect.

26. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.

Before filing a legal claim, we encourage you to contact us and give us a reasonable opportunity to understand and resolve the problem.

Unless applicable law requires otherwise, legal proceedings arising from these Terms or the Services will be brought in a state or federal court with jurisdiction in Maryland.

Nothing in this section deprives a consumer of a mandatory right or protection provided by the laws of the place where that consumer resides.

27. Changes to These Terms

We may update these Terms as the ArtsyGeeksy family grows, our Services change, or legal and operational requirements evolve.

When we make changes, we will post the revised Terms and update the “Last updated” date. When appropriate, we may provide additional notice of a significant change.

Your continued use of the Services after revised Terms take effect means that you accept the updated Terms, except where applicable law requires another form of consent.

28. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. The unenforceable provision will be interpreted or limited as closely as legally possible to its intended purpose.

29. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Shipping and Returns Policy, Refund Policy, and any product-specific terms presented to you, form the agreement between you and us concerning the Services.

If product-specific terms conflict with these general Terms, the product-specific terms control for that product.
